SPPO Question of the Month:
Q: I was just told by my supervisor that if I work a holiday as part of my normal work week, I no longer get overtime(WO). Is that right? A: That is correct. Per a memo passed by DPA on March 29th, 2009, Senate Bill X3 8 amended Government Code Section 19853, so worked holidays will no longer accrue overtime(WO). You will recieve holiday credit and straight time for the time worked instead. As with last month's question, law can supersede when we're working without a contract. James Valdez SPPOAC Vice-President May 5th, 2009 Q: I just received the memo from Deborah Yue re: the DPA change in the Government Code. They are stating that when an employee is off of work for holidays, sick days, vacation, AL, CTO or any other leave those hours shall not be considered as time worked during the week for the purpose of computing cash OT or CTO. Does anyone else have a problem with this? I looked up the contract and it specifically states in 7.6 A. 1. c. that paid leave time shall be counted as hours worked for the purposes of computing OT. Can they just change this in violation of the contract? A: Sadly, yes they can. Since we're working on an expired contract changes in law can supersede, and that's what happened. It is all state employees except CHP, who have a current contract. This is being fought at high levels though I have no way of knowing if it can be succesful.
